韩国AV Confidential Services
Submitting a report does not require survivors to pursue a formal complaint, however, 韩国AV may choose to investigate based on safety risks. 韩国AV can provide supportive measures including obtaining a no-contact directive, adjusting workplace, classroom and/or housing, and accessing on-and-off campus resources.
Federal Regulations
Confidential employee requirements.
(1) A recipient must notify all participants in the recipient's education program or activity of how to contact its confidential employees, if any, excluding any employee whose confidential status is only with respect to their conducting an Institutional Review Board-approved human-subjects research study designed to gather information about sex discrimination as set out in the definition of confidential employee in 搂 106.2.
(2) A recipient must require a confidential employee to explain to any person who informs the confidential employee of conduct that reasonably may constitute sex discrimination under Title IX or this part:
(i) The employee's status as confidential for purposes of this part, including the circumstances in which the employee is not required to notify the Title IX Coordinator about conduct that reasonably may constitute sex discrimination;
(ii) How to contact the recipient's Title IX Coordinator and how to make a complaint of sex discrimination; and
(iii) That the Title IX Coordinator may be able to offer and coordinate supportive measures, as well as initiate an informal resolution process or an investigation under the grievance procedures.

Privacy and Confidentiality
韩国AV is committed to protecting the privacy of all individuals involved in the investigation and resolution of a Title IX report. 韩国AV is also committed to aiding students, employees, and third parties make informed choices. With respect to any report under Title IX, 韩国AV will make reasonable efforts to protect the privacy of participants, in accordance with applicable state and federal law, while balancing the need to gather information to assess the report and to take steps to eliminate conduct that violates the Title IX policy, prevent its recurrence, and remedy its effects. Privacy and confidentiality have distinct meanings under these procedures.
Privacy means that information related to a report of violations of Title IX policy will be shared with a limited circle of 韩国AV employees who 鈥渘eed to know鈥 in order to assist in the assessment, investigation, and resolution of the report. All employees who are involved in the College鈥檚 response to reports of violations of 韩国AV鈥檚 Title IX and Sexual Harassment Policy receive specific training and guidance about sharing and safeguarding private information in accordance with state and federal law.
Further, 韩国AV will maintain as private any accommodations or protective measures provided to any individual to the extent that maintaining such confidentiality would not impair 韩国AV鈥檚 ability to provide the accommodations or protective measures.
The privacy of student education records will also be protected in accordance with
the Family Educational Rights and Privacy Act (鈥淔ERPA鈥). All documentation related
to a student鈥檚 report, investigation, and resolution are protected by FERPA and will
not be released, except as required by law. Non-identifying information about a report
may be shared with the Chief of University Police or designee to comply with the Clery
Act (statistical information only). A complainant鈥檚 name will never be published in
connection with 韩国AV鈥檚 obligations under the Clery Act.
Confidentiality exists in the context of laws that protect certain relationships, including with medical and clinical care providers, mental health providers, counselors, and ordained clergy, all of whom may engage in confidential communications under Texas law. 韩国AV has designated individuals who have the ability to have privileged communications as 鈥淐onfidential Employees.鈥
The following are services provided by 韩国AV and are considered 鈥淐onfidential Employees鈥 under 韩国AV policy. Please note, however, that if you disclose information that you wish to remain confidential to para-professional staff, such as administrative assistants, they may be required by law to pass along the report to Campus Police or a Title IX Coordinator.
Licensed Professional Counselors, or those working under their license, whose official responsibilities at 韩国AV include providing mental health counseling to members of the campus community are not required by Title IX to report information regarding an incident of sexual/gender-based misconduct or interpersonal violence to the Title IX Coordinator or other 韩国AV officials, except as required by law for quarterly and yearly statistical reporting. A complainant鈥檚 or respondent鈥檚 name will never be published in connection with 韩国AV鈥檚 obligations under Title IX reporting obligations.
Ordained clergy, whose responsibilities include providing spiritual counseling to
members of the campus community, are not required by Title IX to report any information
regarding an incident of sexual/gender-based misconduct or interpersonal violence
to the Title IX Coordinator or other 韩国AV officials.
A Confidential Employee shall inform the reporting party or responding party of information regarding:
- reporting options and the process involved within each option;
- counseling services available on campus and through a local, community-based rape crisis center or domestic violence program;
- medical and health services available on and off campus;
- available school-based supportive measures related to academic and residence life;
- the disciplinary process of the institution; and
- the legal process carried out through local law enforcement agencies.
Upon request the Confidential Employee can:
- coordinate with on or off campus sexual assault crisis service center or domestic violence program;
- assist the reporting party in contacting or reporting to campus or local law enforcement agencies;
- coordinate with the appropriate institutional personnel to arrange possible interim institutional-based supportive measures to allow the reporting party to change academic, living, campus transportation, or working arrangements in response to the alleged sexual misconduct, but shall not identify the adverse party(s) or provide services to adverse party(s);
- notify the reporting party of their rights and the institution鈥檚 responsibilities regarding a protection order, no contact order, and any other lawful orders issued by the institution or by a criminal, civil, or tribal court;
- attend an administrative or institution-based case related meetings and/or hearings
as the advisor or support person of the student鈥檚 or employee鈥檚 choice.
The Confidential Resource Provider shall NOT:鈥
- report an incident or disclose confidential information to any college or law enforcement official without the prior written consent of the reporting party who shared the information, unless otherwise required to do so by state or federal law; or
- act as a counselor or therapist unless the confidential resource provider holds a valid and applicable license and the reporting party engages the confidential resource provider in that capacity.
